Content and Intellectual Property Rights

1. Definition and Ownership

Sailwiz allows Users to publish, upload, or make available texts, photographs, audio, videos, opinions, and any other information (hereinafter, the "User Content"). The User retains ownership of the copyright to their Content, without prejudice to the license granted in the following section.

2. Granting of License and Publishing Right

By providing Content through the Platform, the User grants SAILWIZ a non-exclusive, worldwide, royalty-free, irrevocable (for the duration of the legal protection of the right), sublicensable, and transferable license to use, reproduce, distribute, publicly display, and transform said Content. This license expressly includes SAILWIZ's right to edit, modify, adapt, reframe, and retouch images and videos to suit their technical and aesthetic suitability for various advertising media, both digital (social media, banners, email marketing) and physical (posters, press, trade shows). The purpose of this license is the operation, promotion, and advertising of the SAILWIZ Service.

3. Truthfulness and Fidelity of the Images

Users who post advertisements for boats for rent, trips, courses, or any onboard activity are obligated to ensure that the images are accurate, current, and representative of the actual condition of the boat and its equipment. The use of catalog or stock photos that do not correspond to the specific unit being offered or that conceal defects is prohibited. The user will be solely responsible for any claim or refund request arising from a substantial difference between the actual condition of the boat and what is shown in the images.

4. Guarantees and Indemnity

The User guarantees that they are the legitimate owner of the rights or have the necessary authorizations (including image rights of the people appearing in the content). The User will indemnify SAILWIZ against any penalty or damage arising from the infringement of third-party rights. If SAILWIZ must reimburse customers due to inaccuracies in the photos, the offering User will reimburse SAILWIZ for these costs plus administrative fees.

5. Content and Moderation Standards

Content may not be illegal, abusive, defamatory, discriminatory, or violent. SAILWIZ reserves the right to remove, without prior notice, any Content that violates these Terms or is harmful to the Platform.

6. Translations and Third Parties

The Content may be translated using automated tools without any guarantee of accuracy. Furthermore, the User consents to the Content being indexed by external search engines (such as Google), acknowledging that SAILWIZ has no control over the removal of data from external sites.

7. Notification Procedure

Any third party who believes that Content infringes their rights may report it to info@sailwiz.com. SAILWIZ will act with due diligence to remove the infringing content once it becomes aware of it, in accordance with Article 16 of the LSSI (Spanish Law on Information Society Services and Electronic Commerce).
