Integrity and Exclusive Reservation Policy (Anti-Bypass)
1. Prohibition of external transactions
To protect payment security and service coverage, all bookings must be completed through Sailwiz. Users are explicitly prohibited from:
- Offer or request discounts to make the reservation outside the platform.
- Diverting communications or payments to circumvent Sailwiz service fees.
- Requesting or providing contact information (telephone, email, social networks), as well as any other contact information or information that allows access to the contact details of users before the booking is confirmed and paid for.
2. Presumption of Non-Compliance
The exchange of contact data or external links through the messaging system will be considered prima facie evidence of an attempt to circumvent the platform, unless a compelling legal purpose is demonstrated (e.g., requirements of port or border authorities).
Messaging System: Security, Moderation, and Transparency
1. Nature and Purpose
Sailwiz's messaging system is a professional communication channel designed exclusively to facilitate the provision of advertised services. By using it, the User acknowledges that this channel is not private correspondence protected by an expectation of absolute confidentiality, but rather a monitored corporate environment for:
- Security and Anti-Fraud: Detect suspicious behavior or attempted fraud.
- Contractual Compliance: Verify that these Terms of Use are respected.
- Support and Advice: Intervention of Sailwiz agents to help the parties finalize a booking or resolve technical questions.
2. Automated and Manual Processing
Sailwiz uses automated scanning technologies to proactively mask or block identifying information (phone numbers, emails, etc.). In cases of system alerts or user reports, Sailwiz staff may access and review messages and edit or block them if they violate the terms of service.
3. Right to Edit and Block
Sailwiz reserves the right, at its sole discretion and without prior notice, to remove, block or edit any content that violates this policy, including removing links to third-party sites or personal data shared before a booking is finalized.
