Independence from third-party services: travel, accommodation and other expenses

The services advertised through Sailwiz are third-party services not provided by Sailwiz. Users who book additional accommodation, transportation, or other ancillary services do so at their own risk. Sailwiz acts as an advertiser for trips, courses, or boat rental services, but is not the provider of these services and offers only an advertising and connection service.

The following conditions provide transparency regarding the limitation of Sailwiz's liability concerning accommodation, transport or other services contracted on behalf of Sailwiz users.

1. Quorum Requirement : The User acknowledges that certain services advertised on Sailwiz by third parties are subject to a minimum number of participants for their effective execution. The final confirmation of participation and the ultimate feasibility of the activity are the sole responsibility of the advertiser.

2. Refunds : If a service cannot be provided due to insufficient quorum, Sailwiz's liability will be limited exclusively to refunding the amount paid by the User through the platform. The same limitation applies to cancellations resulting from force majeure, in accordance with Article 1105 of the Spanish Civil Code, thereby extinguishing any other obligation of Sailwiz.

3. Nature of the Platform and Exemption from Expenses : Sailwiz operates as an advertising platform that facilitates connections between users and advertisers. It does not act as a package tour organizer or travel agency as defined in Article 151 of the Spanish General Law for the Defense of Consumers and Users (TRLGDCU). Consequently, Sailwiz will not, under any circumstances, assume the cost of services contracted externally by the User (such as flights, trains, transfers, accommodations, or other services) that are affected by the cancellation of an Activity.

4. User Communication and Planning Obligation: It is mandatory for users (advertisers and users requesting bookings) to communicate directly with each other to confirm that the required quorum has been reached and that the advertised activity will actually take place. Users who purchase advertised services must verify that the required quorum has been reached before booking transportation or accommodation. Users who book a service advertised on Sailwiz assume all risk of financial loss for their transportation and accommodation bookings if they have not purchased refundable fares or cancellation insurance.
